These Terms of Use ("Terms") govern your use of the ASKYON HQ website and application at askyonhq.com and its subdomains (the "Service"), operated by Carter McCluskey, trading as ASKYON HQ ("ASKYON", "we", "us", "our"), a sole trader based in Northern Ireland, United Kingdom. By creating an account, entering an access code, or otherwise using the Service, you confirm that you have read, understood and agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.
ASKYON provides general fitness, training and nutrition information and tools. It is not medical advice, and we are not doctors, physiotherapists, dietitians or qualified coaches. Exercise, structured training, and use of a smart trainer carry inherent risks including injury and, in rare cases, serious harm. You take part entirely at your own risk. Consult a qualified physician before starting or changing any exercise or nutrition programme, especially if you are pregnant, have any medical condition, are recovering from injury, or have any doubt about your fitness to exercise. If you feel pain, dizziness, chest discomfort, faintness or breathlessness at any time, stop immediately and seek medical help.
You must be at least 18 years old, or 16 or 17 with the consent and supervision of a parent or guardian, to use the Service. By using it you confirm you meet this requirement and that the information you give us is accurate.
By using the Service you represent and warrant that you are in good physical health and have no medical condition that would make exercise unsafe, or that you have obtained clearance from a qualified physician. You acknowledge that:
Nothing in the Service is intended to diagnose, treat, cure or prevent any disease or condition, or to replace advice from a qualified healthcare or fitness professional. Do not disregard or delay professional advice because of anything you read or calculate in ASKYON.
You are responsible for keeping your login details secure and for all activity under your account. Tell us promptly at support@askyonhq.com if you suspect unauthorised use. You may delete your account and associated data at any time from within the app or by contacting us.
Parts of the Service may be offered on a paid subscription. Where they are:
You agree not to misuse the Service: no attempting to break, overload or reverse-engineer it, no scraping other athletes' data, no uploading unlawful or infringing content, no using it to harass others, and no reselling or redistributing it without our permission. The leaderboard is opt-in; only join it with a display name you are comfortable showing publicly.
ASKYON is independent. We are not affiliated with, endorsed by, sponsored by or connected to IRONMAN, HYROX, Strava, Garmin, Wahoo, Zwift, or any race organiser, brand or event referred to in the Service. All product names, brands and trademarks are the property of their respective owners, and any reference to them is for identification and compatibility only.
If you connect a third-party service such as Strava or Garmin, your use of that service is governed by that provider's own terms and privacy policy. Activities are sent to Strava powered by the Strava API; we are not responsible for those services' availability or accuracy.
Some product recommendations (kit, fuel, groceries) are affiliate links, including via Amazon Associates and Awin. If you buy through them, ASKYON may earn a small commission at no extra cost to you. We only ever suggest items we consider genuinely useful, and a recommendation is not a guarantee of any product's suitability for you.
The Service, including its software, design, text, workouts, plans and branding, is owned by ASKYON and protected by law. We grant you a personal, non-exclusive, non-transferable licence to use it for your own training. You keep ownership of the data you enter and the activities you record; you grant us the limited permission needed to store and process that data to run the Service, as described in the Privacy Policy.
We work to keep the Service running but provide it "as is" and "as available". We do not promise it will be uninterrupted, error-free, or that calculations, estimates and recorded metrics will be perfectly accurate. We may change, suspend or withdraw features at any time.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited or excluded under the law. Those protections for you remain in full.
Subject to that, and to the fullest extent permitted by law:
You agree to reimburse us for reasonable losses and costs we suffer if you breach these Terms or misuse the Service, to the extent the law allows.
You may stop using ASKYON and delete your account at any time. We may suspend or end your access if you seriously or repeatedly breach these Terms, or if we stop offering the Service. On termination, the sections that by their nature should survive (including health disclaimers, liability and intellectual property) continue to apply.
We may update these Terms from time to time. If we make a significant change we will take reasonable steps to tell you, and we will revise the date at the top. Continuing to use the Service after a change means you accept the updated Terms.
These Terms are governed by the laws of Northern Ireland, and the courts of Northern Ireland have jurisdiction, except that if you are a consumer resident elsewhere in the UK you keep the benefit of any mandatory protections of the law where you live. (If your business is based in another UK nation, change this section to match.)
